3Marijuana Dispensaries Shut Down Friday Night

Marijuana customers had fewer choices in Menominee this weekend as three cannabis dispensaries were shut down at least temporarily Friday night, the result of a lawsuit challenging the validity of the city’s revised ordinance to allow more than two dispensaries. On September 26th, Circuit Court Judge Mary Barglind issues a temporary injunction, ordering the city to issue no further dispensary licenses. On October 17th, the judge issued a clarification that any additional licensees who were not open at the time of her September 26th ruling shall be closed. Although Higher Love, Lume, and Nirvana had received licenses under the revised ordinance, they were not believed to be open on September 26th . As of last week, the three were still operating, and the city council held a closed meeting to discuss the case last Wednesday, but no action was taken in open session following the closed session. Then late last week the plaintiffs asked the court to order the city to enforce the previous order, and Friday Judge Barglind ordered the city to take action to close the three facilities for now. The next hearing in the case is set for November 15th.
