The City of Menominee’s sign ordinance did not receive council approval, and the Planning Commission has yet to receive feedback on necessary amendments. Billboard companies have consistently challenged local zoning ordinances on signage for numerous years. In Michigan, sign ordinances are subject to First Amendment scrutiny, with the Sixth Circuit Court ruling that content-based regulations of commercial speech require careful examination. To minimize legal risks, many sign regulations in Michigan must be reassessed and potentially revised.
During the recent Planning Commission meeting, City Manager Brett Botbyl noted, “The council suggested sending the sign ordinance back to the JL/PL committee, which is not an appropriate method for addressing this issue. Since this body is independent and self-governing, it should begin with you. You’ve conducted your due diligence and research. I spoke with the city attorney, and if this body wishes to proceed, we will guide you through the necessary steps.”
Botbyl emphasized, “You decide what direction to take. Either move forward with your decisions or consider the council’s suggestions for changes and collaborate on that front.” This long-overdue update underscores the City of Menominee’s dedication to creating a business-friendly atmosphere while maintaining Menominee’s unique aesthetic and ensuring public safety.
