A major PFAS pollution case is back before a Marinette County judge, just days after the State Supreme Court ruled the Department of Natural Resources can order cleanups of PFAS contamination. The Department of Justice filed a lawsuit in 2022 against Johnson Controls and Tyco Fire Products, alleging they failed to notify the DNR about a PFAS spill and didn’t clean up contamination at their Marinette site. Tyco denies the claims.
The case had been on hold, pending a related Supreme Court decision. Now, with the court supporting state authority to require PFAS cleanups, new proceedings are set. Assistant Attorney General Kevin Grzebielski says the case is moving forward, with another status conference scheduled for September 5th. No trial date has been set. Tyco says it’s spent more than $100 million on cleanup efforts, including groundwater treatment and providing safe water to affected residents.
