In Menominee, a city council member is taking legal action against the city over a planned special election set for August 5th. Councilman Bill Plemel filed a lawsuit arguing the election is illegal. The only item on the ballot is an amendment to the city’s marijuana ordinance. Plemel’s attorneys argue that because it’s not part of a regular election, it shouldn’t move forward. The lawsuit also warns of “irreparable harm” to the city and existing marijuana permit holders if the election proceeds. The ordinance in question, adopted in 2023, allows adult-use marijuana businesses to operate in Menominee. The next court date is Friday, August 1st at 9:30am at the Menominee County Courthouse.
The ballot question asks whether the Menominee Ordinance should be amended to limit the number of marijuana retailers to no more than 9.
The city has already mailed out absentee ballots for the election.
