David Howard Lemery,46, of Wallace, was convicted of Operating While Intoxicated, Third or Subsequent Offense, as a second habitual offender.

The case dates back to December 27th, when Menominee Police stopped Lemery’s vehicle on First Street near Tenth Avenue because of an unusually loud exhaust.

According to Menominee County Prosecutor Jeffrey Rogg, Lemery admitted he did not have a driver’s license and told officers he had consumed several alcoholic drinks. A THC vape device was also discovered in his pocket.

Blood testing later showed Lemery had a point-one-eight-one blood-alcohol level—more than twice Michigan’s legal limit—as well as THC in his system.

Rogg says Lemery’s criminal history includes six prior felony convictions, six misdemeanors and seven previous OWI convictions in Wisconsin and Michigan.

Rogg called habitual drunk driving a continuing threat to public safety, saying repeated opportunities to change had instead become repeated choices.

Judge Christopher Ninomiya imposed the sentence, citing Lemery’s established pattern of behavior and the danger it posed to others on the road.
